Dismissal – The Correct Dismissal Procedure

In April 2009, following the Government’ s Di spute Resolution Review, the statutory dismissal procedure was replaced by a new Acas statutory Code of Practice. The Code does not apply to dismissals due to redundancy or the non-renewal of fixed term contracts on their expiry. The key areas to cover in the correct dismissal procedure are:

  • Establish the facts of each case
  • Inform the employee of the problem
  • Hold a meeting with the employee to discuss the problem
  • Decide on appropriate action
  • Provide employees with an opportunity to appeal
