Patents & Trademarks – Applying for a Trademark
Trademark application
- Any trademark application is processed by the Intellectual Property Office.
Application: form TM3
- The patent application form is called form TM3. (You can download form TM3 at the bottom of this page.)
- Fill in form TM3 in capital letters using black ink, or type them. You must state which goods and services you wish to use your trademark for, including the classes they relate to. (You can find out more about the 45 different classes at the bottom of this page.)
- You need to send form TM3, along with the application fee, to: Intellectual Property Office, Concept House, Cardiff Road, Newport, South Wales, NP10 8QQ.
What happens next
- The Intellectual Property Office will send you an examination report which will tell you whether or not your trademark application is being granted.
Granting a trademark
- If the Intellectual Property Office accepts your trademark application, they will publish it in their Trademark Journal, which is on their website.
- The details published include the name and address of the owner of the trademark.
- The address details can be that of your solicitor or a PO Box number.
Once your trademark is registered
- The Intellectual Property Office cannot refund your application fee for any reason and you cannot alter your trademark after you have sent your form to them.
- To alter your trademark, you would have to apply for a new trademark, following the steps above.
