Smoke-Free Workplace Laws
- It is now against the law to smoke in virtually all substantially closed public places and workplaces.
- Public transport must be smoke-free at all times – including taxis.
- Work vehicles used by more than one person must be smoke-free at all times, even if the two people are never in the vehicle at the same time.
- The work vehicles rule covers vehicles used for voluntary work. However, vehicles that are used primarily for private purposes will not be required to be smokefree.
- If someone smokes somewhere that is legally smoke-free, both the person smoking and the person responsible for the workplace could face a fine.
- A public place is considered substantially enclosed if it has a ceiling/roof and the opening in the walls is less than half the total area of the walls. So, for example, most bus stops are considered substantially closed public places.
- The substantially closed rule covers temporary buildings such as tents and marquees.
